In the News: New building liability rules coming

There’s good news for homeowners thinking about a new build or reno, thanks to the Government’s announcement today of new rules around building liability at an event hosted by NZCB.

Under the previous joint and several liability system, councils – and therefore ratepayers – were ultimately left picking up the bill if something went wrong on a build and the builder was no longer around to sort things out.

Today’s announcement introduces proportionate liability: everyone (architects, designers, builders, engineers) can only be held liable for their part of a job. This means that councils should be less risk averse when it comes to issuing consents, which will speed up the build process and reduce costs due to unnecessary consenting delays.

“This is an important but very necessary decision. It’s now up to us to deliver on it,” says New Zealand Certified Builders Chief Executive Malcolm Fleming.

“The good news is we’re ready. The systems, guarantees, and expertise already exist – now it’s about making sure builders and homeowners understand how these protections work, and which options offer the strongest long-term security.”

Of course, things may still go wrong with a build, which is why the Government is also requiring mandatory warranties – like the Halo 10-Year Guarantee – for residential builds and renovations.

These will typically run for 10 years after a project is finished, and ensure that if the original builder is no longer in operation when a problem appears, there’s a process and money for someone else to step in and sort things out.

Not only does this fairly allocate responsibility, it should help weed out cowboy builders, who won’t have the necessary experience and qualifications to be able to offer these sorts of warranties.

“Mandatory home warranties mean all homeowners are required to secure protection before new build work commences. It also sets the standard for who can operate in the market,” Malcolm says.

“Now the responsibility sits squarely with builders and the protection products they use, and we’re well-placed to implement this change and educate homeowners on the best options available to them.

“Products like NZCB’s Halo 10-Year Residential Guarantee show what strong protection can look like: affordable, comprehensive, and backed by an industry association.”
